New Nationality Law: Government waives retroactive effects, but maintains sanctions for serious crimes

New legislation will therefore not interfere with long-standing citizenship processes. The proposal will be discussed this Wednesday.

The Government will drop the application of retroactive effects in the Nationality Law, but maintain the loss of citizenship for those who commit very serious crimes.

According to information gathered by the newspaper Público , the Executive will give up the transitional regime of the new legislation that would retroactively apply its effects to June 19, the date of the discussion of the Government Program in Parliament.

On the other hand, the Executive decided to maintain the loss of nationality for those who commit crimes considered very serious.

The new proposal also provides for the application of the same system of counting years for access to nationality for European and CPLP citizens , with the deadline for obtaining nationality counting from the date on which legal residence is granted .

Candidates seeking Portuguese nationality will also have to take an exam in Portuguese and in terms of knowledge of the constitutional principles of the rule of law .

The new proposal will be discussed in the Committee on Constitutional Affairs, Rights, Freedoms and Guarantees this Wednesday.

Marcelo hasn't read the proposal yet

The changes will aim to prevent the Nationality Law from being blocked by the Constitutional Court (TC), as happened with the first version of the foreigners law.

In July, after having sent the foreigners' law for preventive inspection by the TC, Marcelo Rebelo de Sousa said that he had not yet read the proposal for the Nationality Law.

Since Parliament decided to postpone the vote until after the summer break, the President of the Republic preferred to wait for the bill to be voted on and arrive in Belém to examine whether there was "any problem of unconstitutionality or any political problem."
